Terms and Conditions
1. Scope
These General Terms and Conditions (hereinafter "GTC") govern the legal relationship or treatment contract between Kieferorthopäde Suisse AG locations (Dietikon, Baar, Goldau, Altdorf, hereinafter "KFOSAG") and the patient, along with the "Medical History Form" completed by the patient at the start of treatment and the "Consent to Transfer Personal Data." These GTC apply between KFOSAG and the patient in the form valid at the time of treatment. They exclusively regulate the business relationship concerning dental treatment (hereinafter "the treatment"), unless otherwise mentioned or agreed. For patients treated by an independent dentist or practitioner, these GTC apply similarly, but the contractual relationship is between the patient and the independent dentist or practitioner.
2. Data Protection
For data protection statements, please refer to the "Consent to Transfer Personal Data" form and the Kieferorthopäde Suisse AG privacy policy, available at www.kieferorthopaede-suisse.ch/agb. By signing the aforementioned form and using the treatment services, the patient consents to the privacy statements.
3. Cancellation Policy
Booked treatment appointments are generally binding, and the agreed time is reserved for the patient. The patient is requested to notify the clinic in advance, but at least 24 hours before, in case of cancellation.
KFOSAG reserves the right to charge a cancellation fee of at least CHF 100.00 for late or missed cancellations.
4. Payment Terms
The parties will discuss the costs of the treatment before it begins, unless it involves standardized treatments.
The costs for the treatment are generally to be paid by the patient within 30 days from the invoice date. A reminder fee will be charged for overdue payments. After the deadline specified in the reminder, KFOSAG may charge an interest on arrears of 5 percent according to Article 73 of the Swiss Code of Obligations. Charging of interest on arrears does not exclude KFOSAG from claiming further damages for delay. KFOSAG reserves the right to transfer debt collection to a third party.
In certain cases, if requested by the patient, KFOSAG offers the option of installment payments. Installment payment terms are generally agreed upon and processed with a third party.
For new patients, emergencies, or if there are signs of poor creditworthiness, KFOSAG reserves the right not to offer all available payment options or to require direct payment/advance payment.
5. Treatment / Liability
The treatment of the patient follows generally accepted standards and rules of dentistry. As is generally the case with medical treatment, a specific treatment outcome cannot be guaranteed. Every medical intervention involves certain risks. Before treatment, the patient will be informed about the various treatment options, as well as the associated risks and costs.
If a treatment does not meet the patient's satisfaction, the patient must notify KFOSAG as soon as possible. KFOSAG is liable for gross and medium negligence caused by intentional or grossly negligent breach of duty by KFOSAG employees. Liability for minor negligence and breaches of duty by assistants or agents is excluded, as far as legally permissible. KFOSAG is not liable for treatment errors or breaches of duty by independently practicing dentists/practitioners.
6. Set-Off Prohibition
The offsetting of claims by KFOSAG from the treatment relationship with non-legally established claims by the patient is excluded unless KFOSAG agrees otherwise in advance.
7. Jurisdiction and Applicable Law
The jurisdiction for disputes arising from or in connection with this contract is Baar, Switzerland. Applicable law is exclusively Swiss law, excluding conflict of laws.
8. Final Provisions
From time to time, these General Terms and Conditions may be amended. The current version is available on our website at www.kieferorthopaede-suisse.ch/datenschutz. The amended version takes effect upon publication on the website.
Should any provisions of these General Terms and Conditions be invalid or unenforceable, the validity of the remaining provisions shall not be affected. Instead of the invalid points, the applicable statutory regulations shall apply, if available.
